This Copyright Policy explains how to report copyright infringement in connection with Sentinel by Reviewal, how we respond, and what happens to a customer who infringes repeatedly. It is incorporated into our Terms of Service.
1. Designated agent
Send notices of claimed copyright infringement to our designated agent:
- Copyright Agent, Chafai Solutions LLC, 16192 Coastal Highway, Lewes, Delaware 19958, United States.
- Email: copyright@reviewal.team. Notices sent to sentinel@reviewal.team also reach us.
You do not need to be a Reviewal customer to send a notice. If your work appears in Sentinel because a customer connected the account it was published from, tell us the account handle and the post link and we will remove our copy and stop monitoring that account while we look into it.
2. How to send a notice
A notice under 17 U.S.C. 512(c)(3) must include all of the following:
- A physical or electronic signature of the owner of the exclusive right that is allegedly infringed, or of a person authorized to act on their behalf.
- Identification of the copyrighted work claimed to have been infringed, or, if a single notice covers several works, a representative list of them.
- Identification of the material that is claimed to be infringing and that you want removed, with enough information for us to locate it (for example the post link, the account handle, or where in Sentinel you saw it).
- Information reasonably sufficient for us to contact you: your address, your telephone number, and, if available, an email address.
- A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notice is accurate, and, under penalty of perjury, that you are authorized to act on behalf of the owner of the exclusive right that is allegedly infringed.
When we receive a complete notice we remove or disable access to the material and tell the customer whose account it relates to, with a copy of the notice.
3. Counter notification
If material of yours was removed and you believe that was a mistake or a misidentification, you can send a counter notification under 17 U.S.C. 512(g)(3) to the same address. It must include:
- Your physical or electronic signature.
- Identification of the material that was removed and the location where it appeared before it was removed.
- A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
- Your name, address and telephone number.
- A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or, if your address is outside the United States, the United States District Court for the District of Delaware, and that you will accept service of process from the person who sent the notice or from their agent.
We will forward a complete counter notification to the person who sent the original notice. If they do not tell us within ten (10) business days that they have filed an action seeking a court order, we may restore the material.
4. Repeat infringers
Reviewal has adopted and reasonably implements a policy of terminating, in appropriate circumstances, the accounts of customers who are repeat infringers. A customer who is the subject of more than one effective notice of claimed infringement that is not withdrawn and is not successfully answered by a counter notification may have their Sentinel account terminated. Termination for repeat infringement does not entitle you to a refund for any paid period.
5. Misrepresentations
Under 17 U.S.C. 512(f), a person who knowingly materially misrepresents that material is infringing, or that material was removed or disabled by mistake or misidentification, may be liable for the damages, including costs and legal fees, incurred by the alleged infringer, by any copyright owner or its licensee, or by us.
6. Reporting other illegal content
If you believe content processed through Sentinel is illegal for a reason other than copyright, you can tell us at the same address. This is our notice and action mechanism under Article 16 of Regulation (EU) 2022/2065. Please include the exact location of the content, an explanation of why you consider it illegal, your name and email address (not required where the notice concerns one of the offences referred to in Articles 3 to 7 of Directive 2011/93/EU), and a statement that you believe in good faith that the information in your notice is accurate and complete. We will confirm receipt without undue delay, tell you what we decided and the reasons for it, and explain how you can challenge that decision.
